Construction Products CE Certification — CPR (CPD) Directive

89/106/EEC is the number of the old EU Construction Products Directive (CPD). The new CE certification regulation for construction products, the CPR Regulation (Regulation (EU) No 305/2011), has been implemented mandatorily since 1 July 2013 and replaces the old directive.

Specific changes of the new regulation: Compared with the old directive, the CPR Regulation imposes stricter requirements on product performance assessment, technical specifications and conformity assessment procedures. For instance, it sets more precise numerical ranges for product performance indicators and adds audit requirements for certain stages within the conformity assessment procedures.

Consequences of failing to affix CE marking: Failure to affix CE marking on relevant construction products placed on the EU market constitutes a clear violation of the CPR Regulation. Economic operators including traders and importers will face penalties such as fines within specific ranges and product recalls.

The new CPR Regulation is much stricter and applies to all construction products circulated and sold on the European market, such as doors and windows, wall coverings, architectural coatings, steel fibres, geotextiles, glass wool and other thermal insulation materials, flooring, roofing materials, bituminous mixtures, gypsum products, concrete aggregates, cement, pipes, floor coverings, sewer equipment, glass, structural metal products, fasteners, waterproof materials, structural timber, traffic signal devices, fire protection equipment and heating equipment. The CPR Regulation puts forward brand-new requirements for all links involved in product circulation, including traders, importers and distributors. All construction products related to health, safety and environmental protection must bear CE marking before being placed on the EU market.


Basic Requirements

Products must be suitable for construction works intended for defined uses, which (as a whole and in their separate components) shall be fit for purpose and economical. Works subject to regulations containing the following Basic Requirements shall satisfy those requirements. Subject to normal maintenance, the Basic Requirements must be satisfied within an economically reasonable service life, and shall generally cover only foreseeable conditions.

1. Mechanical resistance and stability

Construction works shall be designed and constructed such that loads likely to act on them during construction and use do not lead to any of the following incidents:

  • Collapse of the whole or part of the work;

  • Deformation to an unacceptable extent;

  • Damage to other parts of the work or fixed installations resulting from major deformation of load-bearing structures;

  • Damage caused by an accident disproportionate to the intended purpose.

2. Safety in case of fire

Construction works shall be designed and constructed such that in the event of an outbreak of fire:

  • The load-bearing capacity of the structure shall be maintained for a specified period;

  • The generation and spread of fire and smoke within the work shall be limited;

  • The spread of fire to neighbouring construction works shall be limited;

  • Occupants shall be able to escape the work or be rescued by other means;

  • The safety of rescue teams shall be taken into account.

3. Hygiene, health and the environment

Construction works shall be designed and constructed such that they do not pose a threat to the hygiene and health of occupants and neighbours, in particular avoiding any of the following occurrences:

  • Release of toxic gases;

  • Presence of harmful particles or gases in the air;

  • Emission of harmful radiation;

  • Pollution and poisoning of soil or water;

  • Improper disposal of waste water, fumes, solid waste or liquid waste;

  • Dampness on components or internal surfaces of the work.

4. Safety in use

  • Construction works shall be designed and constructed such that they do not present unacceptable risks of accidents such as slipping, falling, collision, burning, electric shock and explosion injury during use.

5. Protection against noise

  • Construction works shall be designed and constructed such that perceptible noise experienced by occupants and nearby persons is kept at a low level so that their health is not endangered and they may sleep, rest and work in satisfactory conditions.

6. Energy economy and heat retention

  • In accordance with local climatic conditions and occupant requirements, construction works and their heating, cooling and ventilation installations shall be designed and constructed to minimise the energy consumed in operation.

7. Sustainable use of natural resources

  • During the design, construction and service life of construction works, consideration shall be given to the rational utilisation and protection of natural resources, emphasis shall be placed on the reusability or recyclability of buildings and their materials, and consumption of non-renewable resources shall be reduced to achieve sustainable development of the construction sector.
