
On 5 May 2017, the Medical Device Regulation (MDR, EU 2017/745) was officially published in the Official Journal of the European Union and entered into force on 25 May 2017.
The MDR had a three-year transition period and became mandatory on 4 May 2020, replacing the former Medical Device Directive (MDD, 93/42/EEC) and the Active Implantable Medical Devices Directive (AIMDD, 90/385/EEC).
The In Vitro Diagnostic Medical Devices Regulation (IVDR, EU 2017/746) was published concurrently with a five-year transition period, taking mandatory effect on 4 May 2022 to supersede the original In Vitro Diagnostic Devices Directive (IVDD).
During the transition periods, manufacturers were required to update their technical documentation and procedures to comply with the requirements of the new regulations. After the transition periods, only medical devices complying with MDR/IVDR could be placed on the EU market.
MDD (93/42/EEC) is a mandatory certification directive for medical devices exported to the EU. All medical device manufacturers or their Authorized Representatives must guarantee that medical devices entering the European Economic Area (EEA) satisfy the requirements of this directive; otherwise, such devices shall not be released onto the market.
Covering medical devices and their accessories, including any instruments, apparatus, equipment, materials and other articles (including software, whether used alone or in combination), whose intended purpose for the human body is as follows:
Diagnosis, prevention, monitoring, treatment or alleviation of disease;
Diagnosis, monitoring, treatment, alleviation or compensation for an injury or disability;
Investigation, replacement or modification of an anatomical or physiological process;
Control of conception.
Note: Products intended solely for medicinal use are excluded. However, where a device is combined with a medicinal product (e.g. drug-device combination product), it shall comply with both the requirements of MDD and relevant pharmaceutical regulations.
In accordance with Annexes IX-XI of MDD and guidance document MEDDEV 2.4, medical devices are classified into the following categories based on risk levels, with different conformity assessment routes applicable to each category:
1. Class I
Class I other: Lowest risk, such as non-sterile general medical masks, non-sterile medical examination gloves, etc.;
Class I sterile: Class I products subject to sterilization treatment, such as sterile medical gauze;
Class I with measuring function: Class I products equipped with measurement functions, such as clinical thermometers.
2. Class IIa: Medium risk, such as sphygmomanometers, hearing aids, etc.;
3. Class IIb: Medium-high risk, such as dialysis equipment, electrocardiographs, etc.;
4. Class III: High risk, such as heart valves, implantable defibrillators, etc.;
*Class III with medicinal products: Class III devices containing medicinal ingredients, such as orthopaedic implants with antibacterial agents.
